Terms

These terms govern your use of NEWALBA, a daily-drop video app distributed on Apple App Store and Google Play. By installing or using the app you accept them. If you do not accept them, do not install the app.

What NEWALBA is

One short video published every day at 00:00 Europe/Rome. The video of today is the only thing you see. When the next day begins, the previous drop is gone. There is no archive, no history, no recovery. This is the entire product. Nothing else is promised.

Pricing

• Free — the app. Downloading and installing NEWALBA costs nothing. There is no install fee, no subscription, no trial.
• €0,49 — each drop. An in-app purchase to unlock today's drop, including the first day you install the app. Optional. Repeats only if you choose to unlock again.

All prices are processed by Apple App Store or Google Play in your local currency, including local VAT where applicable. Apple and Google are the merchants of record for these transactions.

No archive, no recovery

Every drop disappears at 00:00 Europe/Rome the day after publication. Drops are not restored, re-uploaded, refunded, or recovered for any reason — including missed days, device problems, app reinstalls, operating system updates, network outages, force majeure, or your unavailability. Purchasing a drop entitles you only to watch it within its day.

Anti-capture

Screenshots and screen recordings of the in-app video are blocked on the native iOS and Android apps. Any attempt to capture content will result in the screen being replaced by the brand mantra. Bypass attempts (jailbreak, modified clients, screen-record workarounds, external camera capture for redistribution) are prohibited and may result in immediate revocation of access without refund.

Refunds

Refunds for App Store / Play Store purchases are handled exclusively by Apple and Google under their own policies. NEWALBA does not issue refunds directly. Due to the immediate digital delivery, you explicitly waive any statutory right of withdrawal that would otherwise apply to digital content (EU Directive 2011/83, art. 16(m)) the moment a drop is unlocked.

Acceptable use

• Do not reverse-engineer, decompile, or tamper with the app.
• Do not redistribute, re-stream, or rehost the drops.
• Do not record, screenshot, or extract video content.
• Do not use the app to harass, attack, or defame anyone.

Content

All drops, audio, copy, mantras, design and source code are owned by NEWALBA. License granted to you is personal, revocable, non-exclusive, non-transferable, limited to in-app private viewing. No public performance, broadcasting, derivative works, or commercial use is granted.

No support obligation

NEWALBA is designed as a silent ritual. We do not provide customer support, do not reply to messages, do not give explanations about meaning, schedule, or content. You can write to silence@newalba.app for legal or privacy requests. Other messages will not be answered.

Service availability

We aim to publish one drop per day but do not guarantee uninterrupted access. The service is provided "as is" and "as available" with no warranties of any kind to the maximum extent permitted by law.

Liability

To the maximum extent permitted by law, our aggregate liability toward you for any claim related to the app or these terms is limited to the amount you have actually paid to us in the 12 months preceding the claim. Statutory rights of consumers under Italian and EU law are not affected.

Termination

You may stop using the app at any time by uninstalling it. We may suspend or terminate access in case of breach of these terms.

Law and venue

These terms are governed by Italian law. For consumers, the mandatory venue is the court of their place of residence. For non-consumers, exclusive venue is the court of the seat of NEWALBA.

Changes

We may update these terms. The current version is the one published at this URL with the date shown above. Continued use after an update means acceptance.
